By using the Follow website, services, and application, whether as a guest or a registered user (“individually or collectively “user” or “users”), you acknowledge that you have read and reviewed these terms of use (“Agreement”) and accept and agree to be bound by and subject to said Agreement as well as the Follow Privacy Policy. If you do not agree to this Agreement or the Follow Privacy Policy, you must not access or use Follow. 

Follow is offered by The Mission Church of Southern Illinois, 310 North Market Street, Marion, IL, 62959 , (“Mission Church”, “we” or “us”). Follow may be used for your personal, non-commercial use or for the internal use of your non-profit religious organization in accordance with this Agreement. All rights are reserved by MIssion Church, its successors and/or assigns, subject only to rights expressly granted to you.

Updates and Changes 

This Agreement may be modified or updated periodically with said change becoming effective at the time of posting. Your acceptance of any changes is acknowledged by continuing to use or access Follow after a change is posted. 

Not all features and functionalities are available to every user based on choices made by that user. We may modify or discontinue any or all portions or functions of Follow without notice or liability, for any period of time or permanently, for any reason or no reason. 

Unauthorized Use 

You agree not to use Follows in any way that: violates any applicable laws or regulations; has the potential to harm others; impersonates others; exposes others to lability; interferes with any technology or functionality of Follow; attacks or gains unauthorized access to Follow or its users; downloads, sends, knowingly receives, uploads or uses objectionable materials; infringes on the rights of others; advertises for commercial activities; and/or implies the materials are endorsed by or emanates from us. We reserve the right to determine if any conduct, activity, content or use is an unauthorized use. 

You agree that we have the right, but not the obligation, to monitor all content, use and accounts and take any action that we deem appropriate, or refrain from taking any action in our sole discretion, including limiting, terminating or suspending use of Follow for any reason or no reason. 

Without limiting the foregoing, we have the right to fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through Follow. YOU WAIVE AND HOLD HARMLESS MISSION CHURCH, FOLLOW AND THEIR LICENSEES AND SERVICE PROVIDERS AND ALL OF THEIR EMPLOYEES, OFFICERS, MEMBERS, TRUSTEES, AND DIRECTORS FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY ANY OF THE FOREGOING

PARTIES DURING OR AS A RESULT OF LEGAL INVESTIGATIONS AND FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER MISSION CHURCH, FOLLOW OR LAW ENFORCEMENT AUTHORITIES.

User Content 

Users are allowed to post, submit, publish, display, or transmit to other users or other persons content or materials (“User Content”) on or through Follow. Follow is not obligated to review User Content or any other material before it is posted on or through Follow, nor does it ensure prompt removal of objectionable material after it has been posted. We assume no liability for any action or inaction regarding transmissions, communications, or content provided by any user or third party. 

If you provide User Content, you warrant and represent that you own or control all rights in and to the User Content and grant us and our service providers (and each of their and our respective licensees, successors, and assigns) the right to use, reproduce, modify, perform, display, license, distribute, and otherwise disclose to third parties all User Content. 

We do not warrant the accuracy, completeness, or usefulness of any information, materials, content, or User Content found on Follow. Any reliance you place on such information found on Follow is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials, content information or User Content. 

Security 

You agree to keep your account secure, your contact information accurate, and to abide by our security procedures including keeping any user name, password or similar information confidential. You are responsible for all activities that occur under your account or password. You agree to notify us immediately of any unauthorized access to or use of your user name or password or any other breach of security. We have the right to disable any user name, password, or other identifier, whether chosen by you or provided by us, at any time. 

Intellectual Property 

You agree that all materials, information, software, text, images, video, audio design, contents, features, and functionality of Follow are the property of Mission Church (its successors, assigns, licensors, or other providers of such material) including all copyrights, trade secrets, trademarks, patents, the Follow name and logo, the Mission Church name and logo, and all related names, logos, product and service names, designs, and slogans.

You agree not to reproduce, use or distribute our intellectual property in any manner without our prior written consent. All other names, logos, product and service names, designs, and slogans on Follow are the trademarks of their respective owners and shall not be used, duplicated or reproduced without consent by 

those respective owners. You grant Follow and Mission Church a royalty free non-exclusive license to display, use, copy, transmit and broadcast the content you upload and publish. For issues regarding copyright or other intellectual property claims, please contact us.

Third Parties 

Follow accepts no responsibility for content or links to other sites or resources provided by third parties or for any loss or damage that may arise from your use of them. Accessing any third party websites linked to Follow is done at your own risk and subject to the terms and conditions of use for such websites. We are not responsible or liable to you or any third party for the content or accuracy of any materials provided by any third parties. 

Disclaimer of Warranties 

USE OF FOLLOW, ITS CONTENT, AND ANY FUNCTIONALITY, SERVICES, OR ITEMS OBTAINED THROUGH FOLLOW IS AT YOUR OWN RISK, ALL OF WHICH ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER MISSION CHURCH, FOLLOW, NOR ANY PERSON ASSOCIATED WITH MISSION CHURCH OR FOLLOW MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF FOLLOW. WITHOUT LIMITING THE FOREGOING, NEITHER MISSION CHURCH, FOLLOW, NOR ANYONE ASSOCIATED WITH MISSION CHURCH OR FOLLOW REPRESENTS OR WARRANTS THAT FOLLOW OR ANY FUNCTIONALITY CONTENT OR ANY SERVICES OR ITEMS OBTAINED THROUGH FOLLOW WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT FOLLOW OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT FOLLOW OR ANY SERVICES OR ITEMS OBTAINED THROUGH FOLLOW WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

MISSION CHURCH HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. 

Limitation on Liability 

IN NO EVENT WILL MISSION CHURCH, FOLLOW, ITS LICENSORS, SERVICE PROVIDERS, OR ANY OF THEIR EMPLOYEES, AGENTS, OFFICERS, MEMBERS, TRUSTEES, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, FOLLOW, ANY WEBSITES LINKED TO IT, ANY CONTENT OFFERED ON OR THROUGH FOLLOW, OR SUCH OTHER WEBSITES OR ANY SERVICES OR ITEMS OBTAINED THROUGH FOLLOW, INCLUDING ANY DIRECT, INDIRECT,

SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, DATA BREACH, DISCLOSURE OF CONFIDENTIAL INFORMATION INCLUDING PERSONAL PRIVATE INFORMATION, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE. 

THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. 

Indemnification 

You agree to defend, indemnify, and hold harmless MIssion Church, Follow, its affiliates, licensors, and service providers, and its and their respective officers, directors, members, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including attorneys’ fees) arising out of or relating to your violation of this Agreement or your use of Follow including, but not limited to, your User Content, any use of Follow content, services, and products other than as expressly authorized in these Terms or your use of any information obtained from Follow.

Governing Law/ Jurisdiction 

All matters, disputes, or claims relating to Follow and this Agreement shall be governed by and interpreted under the laws of Illinois and applicable federal law. Any suit, action or proceeding arising out of, or related to, this Agreement or Follow shall be brought in Williamson County, Illinois, or if federal, in the United States district court of the Southern District of Illinois. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts. 

Access to Follow may not be legal by certain persons or in certain countries. If you access Follow from outside the United States, you do so at your own risk and are responsible for compliance with local laws. 

Entire Agreement 

This Agreement and our Privacy Policy, as referenced and incorporated herein, constitute the sole and entire agreement between you and MIssion Church with respect to Follow and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral. Waiver of our rights hereunder may only be done in writing. If any portion of this Agreement is adjudicated by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of this Agreement will continue in full force and effect.
